This Licensing Agreement and Terms of Service (the "Agreement") is a legally binding contract between Indergalax Dating (the "Company", "we", "us", or "our") and you, the purchaser or user ("you", "user", "licensee") of our digital products and services (collectively referred to as the "Products"), which include:

Each component of this bundle is designed to guide you step-by-step in improving your dating experience, confidence, and online presence. The Online Dating Profile Correction Helping Hand Bundle is a one-time purchase, not a course, and is available for personal use only.

1. License Grant

Upon purchase, we grant you a non-exclusive, non-transferable, single-user, and perpetual license to access and use the Products for personal, non-commercial purposes only.

This license does not transfer ownership of the Products to you. All intellectual property rights in and to the Products remain the sole property of Indergalax Dating or its licencors. You are only granted a limited right to use the Products as outlined in this Agreement.

2. Authorized Use

Permitted Use:
You are authorized to:

1. Access and use the Products solely for your personal, non-commercial purposes.

2. Download and store a single copy of the Products for personal reference, if such a feature is provided.

Prohibited Use:
You are strictly prohibited from engaging in any of the following activities:

1. Sharing or distribution: Sharing, distributing, or reselling the Products, whether in part or in full, is strictly prohibited.

2. Modification: Modifying, adapting, translating, or creating derivative works based on the Products.

3. Public disclosure: Publicly displaying, publishing, or otherwise disclosing any part of the Products without prior express written consent from Indergalax Dating.

4. Commercial use: Using the Products for commercial purposes or in a manner that directly or indirectly competes with our business.

5. Security circumvention: Attempting to bypass, disable, or circumvent any security features or Digital Rights Management (DRM) measures used to protect the Products.

Enforcement:
Violation of these usage restrictions may result in:

• Immediate termination of your access and license.

• Legal action to enforce our rights and seek damages where applicable.

3. Payment Process and Confirmation

1. Secure Payments:
All payments are processed securely through Bankful, a trusted payment platform that ensures the safety and integrity of your transactions.

2. Delivery of Products:
Products or services will only be delivered after:

4. Account Access and Security

Responsibility for Account Security:

• You are solely responsible for safeguarding any login credentials, private access links, or other secure information associated with the Products.

• Sharing your account, access credentials, or private links with any third party is strictly prohibited and constitutes a breach of this Agreement.

Prohibited Actions:

• Unauthorized sharing, duplication, or distribution of account access or links to the Products.

• Granting access to any third party, whether for personal or commercial use, without our express written permission.

Detection and Consequences of Unauthorized Use:

• If unauthorized access, link sharing, or any other security breach is detected, we reserve the right to:

  1. Suspend or terminate your access to the Products immediately.

  2. Take legal action to protect our intellectual property and business interests, if necessary.

No Refund Policy:

• Termination or suspension due to unauthorized access or sharing will result in the immediate loss of access to the Products, and no refunds will be issued under any circumstances.

Best Practices for Security:

• Use a strong and unique password for any accounts associated with the Products.

• Avoid sharing devices or networks with others who could gain unauthorized access to the Products.

• Contact us immediately at support@indergalaxdating.shop if you suspect any unauthorized use or security breach.

5. Intellectual Property Rights

Ownership of Products:

• All Products, including but not limited to text, images, videos, logos, designs, scripts, and other materials, are the exclusive property of Indergalax Dating.

• All rights, title, and interest in and to the Products, including any associated copyrights, trademarks, and other intellectual property rights, remain solely and exclusively with us.

Protection Under Law:

• The Products are protected by applicable copyright laws, trademark laws, and other intellectual property laws in the UK and internationally.

• Unauthorized use, reproduction, or distribution of the Products, in whole or in part, constitutes an infringement of our intellectual property rights and is strictly prohibited.

Prohibited Actions:
You may not:

1. Copy, modify, distribute, display, or create derivative works of the Products without our express written consent.

2. Resell or commercially exploit the Products in any form.

3. Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in the Products.

4. Attempt to reverse-engineer or extract source materials from the Products.

Enforcement of Rights:

• We reserve the right to take appropriate legal action, including but not limited to seeking damages, injunctions, or other remedies, to protect our intellectual property from unauthorized use or infringement.

No Transfer of Ownership:

• Purchase of the Products does not transfer ownership of the Products or any related intellectual property to you. Your rights are limited to those explicitly granted under the License Grant section of this Agreement.

DMCA and Digital Rights Protection:

• If you believe any part of the Products has been used without authorization, you may report such violations to us at support@indergalaxdating.shop. 

6. Refund Policy

Finality of Purchase:
All purchases of the Products and associated materials are final and non-refundable. No refunds will be offered under any circumstances, including but not limited to:

• Change of mind after purchase.

• Dissatisfaction with the content or materials provided.

• Unauthorized access, sharing, or distribution of the Products.

Non-Refundable Products and Services:
The Online Dating Profile Correction Helping Hand Bundles and associated services, including but not limited to photo ratings, bio writing, prompts, and profile suggestions, are non-refundable once the service has been provided or access to the digital materials has been granted.

Once the private YouTube video link is shared or access is granted, no refunds will be provided, even if the content has not been fully viewed.

This makes it difficult to "take back" access once granted, so the no-refund policy is explicitly clear and applies once access is provided.

You are prohibited from sharing the private video links or distributing the content in any way. Unauthorized sharing or distribution of the content may result in immediate termination of access and potential legal action.

10. Important Notice Regarding Platform Availability

Courses May Be Moved to Another Platform:

These digital products, videos, and resources may be moved to a different platform or may become unavailable at any time due to technical, business, or other unforeseen reasons.

12. Governing Law and Jurisdiction

This Agreement is governed by and construed in accordance with the laws of England and Wales. By purchasing and using the Products, you agree to submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes arising out of or in connection with this Agreement.

However, international customers may be entitled to additional consumer protection rights under the laws of their country of residence. Nothing in this Agreement shall override or limit these rights. Where applicable, local consumer laws may provide additional protections, such as the right to a refund within a specific period, which are not affected by the terms set out in this Agreement.

13. DRM, Watermarking, and Anti-Piracy

To protect our intellectual property and prevent unauthorized sharing or distribution, we employ Digital Rights Management (DRM) measures and personalized watermarking throughout our digital products. In particular, we insert a branded box featuring our business name, our YouTube channel name, and a direct link to the channel at various points in course videos. This ensures clear identification and traceability of ownership.

Prohibited Actions

Any attempt to do the following is strictly forbidden:

1. Remove, modify, or bypass DRM protection.

2. Alter, obscure, or remove any watermarking or branded box from the Products.

3. Distribute, share, or otherwise make the Products available to third parties without explicit permission.

Consequences of Violation

If we detect any violation of these restrictions, we reserve the right to:

1. Immediately terminate access to the Products.

2. Pursue legal action to protect our intellectual property and enforce this Agreement.

Agreement to Comply

By purchasing and accessing the Products, you agree to:

• Respect all DRM and watermarking measures in place.

• Refrain from any action that would compromise our intellectual property rights.

• Honor the business branding, including the visible box displaying our name, YouTube channel, and link, as an integral part of the Product’s presentation.

14. Modifications to this Agreement

We reserve the right to modify or amend this Agreement at any time. Any changes to this Agreement will be effective immediately upon being posted on our website or communicated via email, unless otherwise specified.

• Notification of Changes: We will notify you of any significant updates to this Agreement through the contact details you provided during your purchase (e.g., email). The most recent version of the Agreement will always be available on our website for your review.

• Acceptance of Changes: Continued use of the Products after such modifications have been made constitutes your explicit acceptance of the revised Agreement. If you do not agree to the changes, you must cease using the Products and request termination of your access.

15. Risk Mitigation

To minimize potential misunderstandings and dissatisfaction, we strongly recommend that customers thoroughly review product descriptions, content previews, and any associated materials before making a purchase.

• Customer Responsibility: Once payment is made and access is granted, it is the customer’s responsibility to ensure proper use of the Products in full compliance with this Agreement.
